alright. got a new bike. here's the question: is it stolen or simply found?
i was biking home from somewhere (the bar) and saw a bike on the bike rack in front of kava house in eastown. i noticed it was unlocked so i turned around to check it out. it was about 1:00am, keep in mind. sure enough, the thing is unlocked. its seat is fucked up a bit, and the right pedal is missing. so i park and lock my other bike down the road, walk back, take a good look around for anyone who might own this abandoned bike, and ride it home and spray paint it black.
so here's the question: did i steal it or find it? i've heard mixed answers to this and would like some more input.

see how slippery of a concept property is? everything found is stolen and vice versa, in some ways. your improvements to the bike give you squatter's rights to it.
stolen: anything found under a lamp.

Interesting and I couldn't help but comment... but don't see how this lacks clarity, as the bike was definitely stolen.
The #1 Definition of steal:
1. to take (the property of another or others) without permission or right, esp. secretly.
might I add that
a) The reason bikes lock exist is to prevent stealing - not to notify others that it has an owner.
b) The fact you had to spray paint it is also evidence that you wished to conceal you actions.(I would say that the "especially secretly" aspect of the stealing definition applies.
